Terms & Conditions

 

1. The contract between you (the customer) and us (AllyMPearls) is subject to the following terms and conditions:

Payment in full for the goods you ordered must be received before your order can be accepted. Once we receive full payment, we will send you an acknowledgement email to the email address you provided on the order form. Please note that this email is not an order acceptance confirmation from AllyMPearls. Our acceptance of your order occurs when we dispatch the products you ordered, unless we notify you otherwise. Please be aware that we reserve the right to not accept your order. The acceptance of your order creates a legally binding contract between you (the customer) and AllyMPearls. If you do not meet the requirements to execute a legally binding contract, please refrain from using this site.
2. Return and Exchange Policy:
2.1 Fully priced goods: If you are not satisfied with your purchase within 7 days of receiving it, AllyMPearls offers a full refund or exchange of the item. Please note that pearls, due to their organic nature, may vary in appearance and color. To be eligible for a refund or exchange, the item you return must be in new, unused, and unworn condition, with all the original packaging. AllyMPearls will not accept any item that shows signs of use. In such cases, the item will be returned to the purchaser.  Before returning an item, you must notify us within 48 hours of receiving it by emailing us at Ally@AllyM-Pearls.co.uk, quoting your order number. We will provide you with a Return Reference (RR) number and the delivery address, which you will need for your refund or exchange.  When returning the item, please include the original receipt in the parcel and state your Return Reference (RR) number on the receipt. Please note that returned items without an official Return Reference number will not be accepted.  You must return the goods using Recorded/Signed for Service only. Please note that all postal or courier costs for returned goods are the customer's responsibility. We will reimburse these costs only in the case of incorrectly supplied goods. Please retain your proof of postage certificate, as AllyMPearls will not be responsible for any goods lost or damaged in transit. Please note that AllyMPearls does not accept liability for returned goods if they are not returned via Royal Mail Special Delivery, Tracked and Signed for postal service, DHL, or FedEx.  In the event of an exchange, please note that you will be required to pay any price difference and additional carriage or shipping charges. Any remaining credit will remain on your account for future purchases. Exchanged items can only be dispatched after the returned goods have been received and passed a satisfactory quality control check. 

2.2 Sale Items: If you are not satisfied with your purchase, we request that all sale items be returned within 3 working days of receiving your Return Reference (RR) number. Please note that pearls, due to their organic nature, may vary in appearance and color.  Returns of sale items outside the mentioned time frame are accepted at the discretion of AllyMPearls and can only be refunded as an AllyMPearls store credit or exchanged for a different item. The item you return must be in new, unused, and unworn condition, with all the original packaging. AllyMPearls will not accept any item that shows signs of use. In such cases, the item will be returned to the purchaser.  Before returning a sale item, you must notify us within 48 hours of receiving it by emailing us at Ally@AllyM-Pearls.co.uk, quoting your order number. We will provide you with a Return Reference (RR) number and the delivery address, which you will need for your refund  or an exchange.
Please note that the item you return must be in new, unused, and unworn condition with all the original packaging. AllyMPearls will not accept any item with any indication that it was used. In such cases, the item will be returned to the purchaser.
Before your return you must notify us within 48 hours of receiving an item by emailing us at Ally@AllyM-Pearls.co.uk quoting your order number. We will provide you with your Return Reference (RR) number and the delivery address, which you will need for your refund and exchange.
Please also include the original receipt in the returned parcel. Please note that you must state your Return Reference (RR) number on the receipt. Any returned items that are not accompanied by an official Return Reference number will not be accepted.
You must return the goods in the condition in which they were supplied to you and by Recorded/Signed for Service only.  Please note that all postal or courier costs for returned goods are the customer's responsibility and will be reimbursed by us only in the case of incorrectly supplied goods. Please keep your proof of postage certificate, as AllyMPearls will not be responsible for any goods lost or damaged in transit. Please note that AllyMPearls do not accept liability for returned goods if you do not return them to us via Royal Mail Special Delivery, Tracked and Signed for postal service, DHL or FedEx.
In the event of an exchange please be aware that you will be required to pay any difference in cost and any additional carriage, shipping. Any unused credit will remain on your account until your next purchase. Please note that exchanged items can only be dispatched after the returned goods have been received and passed a satisfactory quality control check.

2.3 Earrings and Bespoke or Specially Commissioned Items 

Please note that we are unable to accept returns or exchanges on pierced earrings, bespoke, or specially commissioned items. Bespoke and commissioned items cannot be refunded as consultation throughout the design process would have taken place. For hygiene reasons, AllyMPearls cannot exchange or refund earrings unless they are faulty.  

3. Cancellation of Order by AllyMPearls 

3.1 As AllyMPearls designs are handmade, we reserve the right to cancel your order in the unlikely event of: 

3.1.1 Having insufficient stock to deliver the goods you have ordered, 

3.1.2 The ordered item is no longer available, 

3.1.3 We do not deliver to your area, 

3.1.4 One or more of the items you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information. 3.2 If we do cancel your order, we will contact you by email or telephone, and we will re-credit the amount to your credit card within 30 working days of your order. Please note that AllyMPearls is not obligated to offer any compensation for your disappointment.  

4. Delivery 

4.1 We will deliver the goods ordered by you to the address you provide us for delivery at the time you make your order. It is solely your responsibility to ensure that the delivery address you provided us with during the transaction is correct. 

4.2 UK Delivery Delivery to addresses within the UK will be dispatched within 7 days. Please note that parcels will need to be signed for in person. Please ensure that the delivery address is accurate when ordering from AllyM-Pearls.co.uk and that there will be someone to sign and take delivery of the goods when they arrive. If you miss the delivery, Royal Mail will leave an information note, and you will be able to collect your parcel from the post office.  Price breakdown below:  Orders under £50.00 are sent via Royal Mail Special Delivery service and charged at £5.00 per order. Orders over £50.00 will be sent via Royal Mail Special Delivery service and charged at £9.50 per order. Orders over £150.00 will be sent via Royal Mail Special Delivery service and are free of charge. Please note that www.AllyM-pearls.co.uk cannot be held responsible for any postal delays once the goods have left our premises.  

4.3 Orders outside the UK (Europe only) Delivery to addresses outside the UK (Europe only) will be dispatched within 7 days. Please note that parcels will need to be signed for in person. Please ensure that the delivery address is accurate when ordering from www.AllyM-Pearls.co.uk and that there will be someone to sign and take delivery of the goods when they arrive. If you miss the delivery, the Postal Service will leave an information note, and you will be able to collect your parcel from the post office.  Price breakdown below:  Orders under £50.00 are sent via Royal Mail Special Delivery service and charged at £7.50 per order. 5. Our Liability 

5.1 AllyMPearls shall not be liable to you unless you notify us by email within 7 working days if the delivery of the products ordered was either damaged or sent incorrectly. Please keep in mind that due to their organic nature, pearls are not uniform in appearance or color. Upon your request, our only obligation to you will be:  

5.1.1 to replace damaged product(s) 

5.1.2 to make good any shortage or non-delivery; or 

5.1.3 to replace any goods that are damaged or defective (once the items have been returned and inspected by us. Please note that AllyMPearls will not accept any item with any indication that it was used. In such cases, the item will be returned to the purchaser); or 

5.1.4 to refund to you the amount paid by you for the goods in question in whatever way we choose.  

5.2 If you do not receive goods ordered by you within 14 working days of the date on which you ordered them, we shall have no liability to you unless you notify us by email of the problem within 14 days of the confirmed dispatch date. If you notify us of a problem under this condition, our only obligation will be, at your option, either:  

5.2.1 to make good any shortage or non-delivery; or 5.2.2 to refund to you the amount paid by you for the goods in question in whatever way we choose.  

5.3 AllyMPearls shall not be liable in any way for any death or personal injury resulting from your negligence and/or due to the inappropriate use of the products. 

5.4 Please note that our terms and conditions are not intended to limit consumer rights or statutory rights.  

5.5 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import, or other permits to purchase goods from our site. The importation or exportation of certain goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.  

5.6 We shall not be held responsible for any delays once the goods have left us and are in possession of the courier or Royal Mail.  

6. Pricing, Delivery, Discount Codes, and Gift Voucher/e-voucher Redemption 

6.1 The prices payable for goods that you order are as set out on our website.  

6.1.1 All of our prices are in UK Pounds, and you will be billed in UK Pounds. If you purchase from outside the UK, currency fluctuations and credit card charges may make a difference in the amount billed on your credit card.  

6.2 Please note you may be required to pay extra for delivery, and it might not be possible for us to deliver to some locations. Our delivery charges are set out on our website.  

6.3 Promotional discount codes: We may offer promotional discount codes (either directly or via third parties) which may apply in respect of any or certain specified purchases made through this Website. Such codes may only be applied to purchases of full-price items and cannot be used in conjunction with any other offer or discounts.  

6.4 Gift Voucher/e-voucher redemption  

6.4.1 AllyMPearls gift vouchers and e-vouchers can only be redeemed online at www.AllyM-Pearls.co.uk website, and the recipient must register for their AllyMPearls account.  

6.4.2 When redeeming a gift voucher or e-voucher online, you will be required to enter the gift voucher or e-voucher ID during checkout as given in the recipient's email.

6.4.3 The total value of an online order must be the same as or greater than the value of the voucher or e-voucher; otherwise, the system will be unable to process the payment.  

6.4.4 If you need to return goods that you have purchased online using a gift voucher or an e-voucher, we will provide the refund in the form of an e-voucher, gift voucher(s), or account credit. 6.4.5 Gift vouchers and e-vouchers may not be exchanged for cash and are non-refundable.

Each and every transaction carried out is deemed to be completed within the United Kingdom and, therefore, shall be governed by and interpreted in accordance with English Law. The terms of this charter and any claims, disputes, controversies, or proceedings whatsoever shall be governed and interpreted within English Law, and the English Courts shall have exclusive jurisdiction in relation to them.

While we endeavor to ensure that the information provided on AllyM-Pearls.co.uk is accurate, we do not guarantee the exactness and completeness of the material on this website. We reserve the right to make changes to the material on this website, or to the services and prices described on the website, at any time and without notice. The material on this website may be out of date, and we make no commitment to update such material. Other than any service you decide to accept on separate terms and conditions from us, the material on this website is provided 'as is' without any conditions, warranties, or other terms of any kind. 10. Events out of our Control 

AllyMPearls will not be in breach of this Agreement or otherwise liable for any delay in performance if the delay or failure is due to circumstances beyond its reasonable control, including but not limited to strikes, lockouts, other industrial disputes, breakdown of systems or network access, flood, fire, explosion, or accident.  

AllyMPearls designs All of our designs are handmade by AllyMPearls and may feature pre-made components such as chains, charms, or clasps. Please note that silver may change color and darken over time. It is advisable to clean and polish the silver components by hand.  AllyMPearls designs also include semi-precious stones, freshwater pearls, CRYSTALLIZED™- Swarovski Elements, and other types of beads.  

11. Colour Reproduction 

We assure you that every effort has been made to reproduce colors on the site as accurately as possible. Please note that some computers may display colors slightly differently, and therefore exact matches may not be possible over the Internet. Additionally, please be aware that the colors of the products may slightly differ from what you see on your screen when ordering. Furthermore, due to their organic nature, freshwater pearls vary in sizes, shapes, and colors, and may not be perfect.  

12. AllyMPearls rights 

We reserve the right to change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed as your acceptance of the modified conditions. It is your responsibility to regularly check for any changes in the Conditions. If you do not agree to any change in the Conditions, you must immediately stop using the Website.

AllyMPearls has not reviewed all the sites linked to its Web Site and does not control or take responsibility in any way for these websites or their content or availability.
